The Office of the Prosecutor of the Court of Cassation and High Justice in Romania referred a complaint submitted by the Hind Ragab Foundation against the Israeli soldier, Aurel Beniish, to the Military Public Prosecution of the Military Court of Appeal in Bucharest to follow up the investigation.

The complaint, which was submitted by Lawyer Ilina Lazar, on behalf of the Foundation, accuses the soldier, we live – a member of the 432 battalion of the “Jaftati” brigade – of participating in the deliberate destruction of civilian property during the Israeli aggression on the Gaza Strip, specifically in the Nasserat camp on November 12, 2024.

The Foundation welcomed the Roman step, considering that the referral represents a “serious treatment compatible with international legal standards.”

The complaint is based on open source evidence, from photos and videos posted on social media that document the soldier’s involvement directly in the destruction of civil infrastructure.

According to the complaint, the actions of the suspect violate Articles 438 and 441 of the Roman Penal Code, which criminalize genocide and war crimes against property, as well as international sukuk such as the Rome Statute of the International Criminal Court and the Geneva Conventions, which Romania is a party.

The lawsuit also indicates that the documented destruction is part of a wider pattern of Israeli violations, especially the use of the Netsarim Corridor as a strategic military road that led to the displacement of civilians and the destruction of large civilian areas in Gaza, according to what was documented by Forensic Arcity and international observers.

The Hind Ragab Corporation called on the Roman authorities to take preventive measures such as the inclusion of the accused on the monitoring lists, the confiscation of possible digital evidence and the opening of a comprehensive official investigation.

For his part, Diab Abu Juhaj, head of the Human Rights Organization in Romania, commented that “referral to the Military Prosecution is a serious development. It is a clear indication that Romania takes its international legal obligations seriously, and shows its willingness to consider holding the perpetrators of war crimes, even if it is committed outside its territory.”
