The judicial advisor of the Israeli government, Ghali Bahraf Mayara, ruled that the appointment of Prime Minister Benjamin Netanyahu, Major General David Zaini, as head of the Israeli Public Security Service (the Shin Bet) is legal and rejected.
This came in a legal point of view published by Baharrav Mayra in a statement, in light of the controversy witnessed by Israel after Netanyahu (required for the International Criminal Court) announced the appointment of Zeni as president of the Shabak, amid the accusation of his opponents to him that this appointment was made according to political considerations.
The judicial counselor said, in her statement, which was sent to Netanyahu, that he was involved in the conflict of dangerous interests regarding the appointment of the new Shin Bet, and that he acted, contrary to the decision of the Supreme Court (the highest judicial authority), in a deliberate violation of binding legal directives.
There is talk about conflict of interests, as the Shin Bet, a participant in the management of ongoing investigations in two cases with close associates of Netanyahu.
The judicial counselor concluded that the decision regarding Major General Zaini, who was taken in light of the conflict of interest is an illegal and rejected decision.
She added: In the future, the Prime Minister must refrain from being involved in any way – directly or indirectly – to appoint the next Shin Better or his acting, at least until the end of investigations related to relevant issues.
She said that in order to ensure the continuity of the work of the Shin Bet, and to ensure a sound appointment to the head of the agency, the legal solution is to transfer the authority to appoint another minister, who will submit a candidate in front of the government, which is authorized to appoint.
The statement of the judicial advisor to the Israeli government sparked angry reactions, as a number of ministers of the right -wing government coalition launched a severe attack on it, and the Minister of Communications, Shlomo Kara’i, wrote, through the X platform, that the attempt to prevent the prime minister from appointing the Shin Bet at the time of a war is a prejudice to the security of the state and demanded that the judicial advisor be held accountable and dismissed.
The Minister of Heritage, Amihai Eliaho, also wrote, “It is time for Pharav Mayra to put the keys aside.
On Wednesday, the Israeli Supreme Court ruled that the decision of the Netanyahu government to dismiss a bar is violating the law, while Netanyahu, who is required for international justice, justified the decision to dismiss Bar with lack of confidence in it, as part of the repercussions of the events of October 7, 2023.
